Terms and Conditions for Vivo Beverage and Bar Services
Welcome to VIVO. These Terms and Conditions ("Terms") govern your use of our bartending services. By engaging our services, you agree to these Terms. Please read them carefully before proceeding.
1. General Overview
1.1 Service Description: Vivo provides onsite and mobile beverage & bartending services, including rentals, decor design, bar setups, beverage preparation, and related services for events.
1.2 Eligibility: Clients must be 21 years or older to engage in our services. All event attendees consuming alcohol must also be at least 21 years old. Valid identification may be required at events to verify age.
2. Booking and Payments
2.1 Booking Confirmation: Services are confirmed only upon receipt of a signed contract and payment of a non-refundable deposit , as specified in your service agreement.
2.2 Payment Terms: The remaining balance is due 3 days before the event date . Payments can be made via online payment link, Venmo, or Zelle. Late payments may incur additional fees.
2.3 Cancellations and Refunds: Cancellations must be made in writing. Refund eligibility is as follows:
- Cancellations 30 days or more prior to the event: Refund of payments made, minus the non-refundable deposit.
- Cancellations within 30 days: No refund.
3. Alcohol Compliance
3.1 Liquor Licensing: Vivo operates in compliance with all applicable California liquor laws and regulations. We do not sell alcohol; instead, we serve alcohol provided by the client or a licensed vendor.
3.2 Alcohol Provision: The client is responsible for procuring all alcoholic beverages unless otherwise agreed upon in writing.
3.3 Refusal of Service: Our staff reserves the right to refuse service to any individual who appears intoxicated, underage, or behaves inappropriately, in accordance with California laws and safety protocols.
3.4 Permits: It is the client’s responsibility to secure any necessary alcohol permits for their event. We can assist with guidance but are not responsible for securing permits unless explicitly agreed.
4. Liability and Indemnification
4.1 Client Responsibility: Clients assume full responsibility for the conduct of their guests and agree to indemnify and hold Vivo harmless against any claims, damages, or liabilities arising from the actions of attendees.
4.2 Damage to Equipment: Clients are responsible for any damage to Vivo’s equipment caused by guests, venue staff, or other third parties during the event.
4.3 Insurance: Vivo maintains general liability insurance. However, we strongly recommend that clients secure event liability insurance to cover additional risks.
5. Health and Safety
5.1 Cleanliness Standards: Vivo adheres to strict health and hygiene standards. All equipment and supplies are sanitized before and after each event.
5.2 Allergies and Dietary Restrictions: Clients must inform Vivo of any allergies or dietary restrictions in advance. While we take precautions, we cannot guarantee an allergen-free environment.
6. Event Logistics
6.1 Setup and Breakdown: Vivo requires 2-3 hours for setup and 2 hours for breakdown . Access to the venue must be arranged accordingly.
6.2 Venue Requirements: The client must ensure the venue has adequate space, access to power and water (if applicable), and meets all safety requirements.
6.3 Weather Policy: For outdoor events, clients must provide adequate shelter for Vivo’s staff and equipment. In cases of severe weather, alternative arrangements must be made.
7. Intellectual Property
All materials provided by Vivo, including branding, menus, and custom bar designs, remain the intellectual property of Vivo and may not be used or reproduced without our written consent.
8. Amendments and Termination
8.1 Changes to Terms: We reserve the right to update these Terms at any time. Clients will be notified of material changes prior to their effective date.
8.2 Termination of Services: Vivo reserves the right to terminate services in cases of non-compliance with these Terms or if safety concerns arise during the event.
9. Governing Law
These Terms are governed by the laws of the State of California. Any disputes arising from these Terms shall be resolved in the courts of [appropriate jurisdiction].
10. Event-Specific Compliance
10.1 Private Events at Residences

Licensing and Permits: Generally, if alcohol is provided free of charge and not included in any admission fee, a special license may not be required. However, if alcohol is sold or included in the price of admission, the client must obtain a Daily License appropriate for the event.

Client Responsibility: Clients must ensure compliance with local ordinances and homeowner association rules regarding the hosting of events with alcohol service.
10.2 Public Festivals and Large Events (e.g., Concerts)

Special Event Permits: Clients are responsible for securing all necessary special event permits from local authorities. Applications should be submitted well in advance, typically at least 60 to 90 days before the event, depending on local regulations.

Alcohol Service Licensing: For events where alcohol is sold, clients must obtain the appropriate Daily License (e.g., Daily Beer and Wine License or Daily General License) from the California Department of Alcoholic Beverage Control (ABC). These licenses are typically issued to valid non-profit organizations for fundraising events.

Responsible Beverage Service (RBS) Training: At least one person involved in alcohol service at the event must be RBS trained and certified, present at the event, and actively oversee alcohol service for its entire duration. Local municipalities may require more than one server to be RBS certified.
10.3 General Provisions for All Events

Event Authorization: If the event involves selling alcoholic beverages on property adjacent to a licensed premises, an event authorization from the ABC is required. This permits the licensee to sell alcoholic beverages for consumption on the specified property.

Insurance Requirements: Clients must provide proof of event liability insurance, including liquor liability coverage, naming Vivo as an additional insured party.

Compliance with Local Regulations: Clients are responsible for adhering to all city or county-specific regulations, including noise ordinances, occupancy limits, and health and safety codes.

Security Measures: For large public events, clients must arrange for adequate security personnel to ensure the safety of attendees and compliance with alcohol service laws.

Age Verification: Clients must implement robust age verification processes to prevent underage alcohol consumption.
